It goes without saying that family members do not always get along with each other. However, when arguments between couples escalate, or when other issues arise that affect the safety of children or other family members, the authorities may become involved. In these cases, it is important to make sure all family members are safe from harm, but those who have been accused of committing domestic violence will also need to take the proper steps to protect their rights and determine how they can address criminal charges. They can do so by working with a criminal defense attorney who has experience handling family-related issues.

At the Law Office of Russ Alan Baker, PLLC, we understand the sensitive nature of cases involving domestic violence, and we are dedicated to helping our clients address and resolve these situations. In addition to defending clients in criminal cases, Attorney Russ Baker assists with family law matters and investigations by Child Protective Services. Family Violence Charges in Texas

The laws of the state of Texas refer to domestic violence as "family violence." A person may be accused of family violence if they allegedly committed an act against a member of their family or household that was intended to cause physical harm or bodily injury or if they threatened to do so. Family violence charges may also involve accusations of child abuse, which may include situations where a person allegedly caused a child to experience a physical injury, engaged in sexual conduct that affected a child's mental or physical welfare, used controlled substances in a way that resulted in physical or emotional injury to a child, or allowed a child to use illegal drugs.

Family violence charges will involve acts that were allegedly committed against members of a person's family or household. These may include married spouses, unmarried couples, ex-spouses, children, step-children, parents who have a child in common, couples who are dating or who were formerly in a dating relationship, or anyone else who resides in the same home.

Domestic assault is the most common offense that a person may face in cases involving family violence. A person may be charged with domestic assault if they are accused of intentionally or recklessly injuring a member of their family or household, threatening to inflict bodily injuries, or intentionally making contact with a person in a way that the person considered to be provocative or offensive. Domestic assault is usually charged as a misdemeanor, although it may be elevated to a felony if a person had previously been convicted of a family violence offense.

A person may be charged with aggravated domestic assault if they are accused of committing assault against a family or household member in which they allegedly used a deadly weapon or inflicted a serious bodily injury. Aggravated domestic assault may be charged as a first-degree or second-degree felony. If a person is accused of committing domestic violence two or more times within a period of 12 months or less, they may be charged with continuous violence against the family, which is a third-degree felony.
